U.S. IMMIGRATION LAW UPDATE
Updated October 21, 2026
Is DV-2027 Registration Open After the Federal Court Order?
DV-2027 registration is not yet open as of October 21, 2026. A federal judge ordered the U.S. Department of State to restart the delayed Diversity Visa 2027 program, but the government has appealed and requested a stay of the injunction.
Under the amended court order, the Department must announce registration details by October 29 and open registration by November 1, 2026. These are judicial deadlines, not confirmed dates independently announced by the State Department. A subsequent court order could change the schedule.
CURRENT REGISTRATION STATUS
Registration closed — awaiting official State Department announcement
Applicants cannot submit a valid DV-2027 entry until the government activates the official registration system. The State Department's existing notice still says the registration opening and selection-result dates will be announced separately.

01 / COURT TIMELINE
DV-2027 Registration: New Deadlines Under the October 2026 Court Order
On October 14, 2026, U.S. District Judge Jinsook Ohta granted a preliminary injunction in Red Eagle Law, L.C. v. Rubio, Case No. 3:26-cv-04738-JO-VET, in the U.S. District Court for the Southern District of California.
The court directed Secretary of State Marco Rubio and the Department of State to implement the delayed DV-2027 lottery. Later that day, the court approved a modification of the initial schedule, giving the Department additional time to comply.
The amended schedule, contained in Docket Document 23, controls the relevant deadlines unless a later judicial ruling changes it. The October 19 written opinion, Document 24, explains the court's legal reasoning.
ANNOUNCEMENT DEADLINE
October 29, 2026
The State Department must publicly announce the DV-2027 registration period, including the opening and closing dates, official entry website and participation requirements.
REGISTRATION OPENING DEADLINE
November 1, 2026
The amended injunction requires the Department to open the registration period by midnight Eastern Time on November 1, with registration lasting 30 days. The opening remains subject to any further court order, including a possible stay.
SELECTION NOTIFICATION DEADLINE
December 3, 2026
The court requires the Department to notify selected entrants by this date. Under the normal DV procedure, selection results are available through Entrant Status Check, not personal winner emails. The government has not independently confirmed the DV-2027 result-access date.
COURT-ORDERED PROCESSING HORIZON
September 20, 2027
The amended injunction directs timely processing of DV-2027 applications under normal procedures until the annual visa allocation is exhausted or September 20, 2027, whichever occurs first. This is not the statutory end of the DV-2027 visa year.
STATUTORY VISA-YEAR DEADLINE
September 30, 2027
Fiscal year 2027 ends. Under the ordinary statutory framework, DV-2027 visa eligibility cannot simply be carried into the next fiscal year. The October injunction does not extend this cutoff.
The court establishes what the government must do. The Department must still publish its registration instructions and activate the electronic system. Applicants should rely on the actual dates and Eastern Time cutoff announced by the Department, particularly if litigation changes the schedule.

02 / LEGAL ANALYSIS
Why Did the Federal Court Order the DV-2027 Lottery Reopened?
The dispute concerned whether the State Department could effectively prevent an annual Diversity Visa program from operating by failing to conduct the registration and selection process.
Congress established the Diversity Visa Program through the Immigration Act of 1990. The program is governed by provisions including 8 U.S.C. §§ 1151(e), 1153(c) and 1154(a)(1)(I), together with implementing regulations such as 22 C.F.R. § 42.33.
The statute provides an annual immigration opportunity for qualifying people from countries with historically low levels of immigration to the United States. The Department of State administers the registration and selection process.
Ordinarily, registration takes place before the fiscal year in which the selected applicants may receive immigrant visas. However, the Department did not conduct DV-2027 registration before fiscal year 2027 began on October 1, 2026.
In November 2025, the Department had announced that it was implementing changes to the entry process and would publish registration dates later. No registration period followed before the start of FY2027.
The Administrative Procedure Act Was Central to the Decision
In its October 19 written opinion, the court concluded that Red Eagle Law had shown a likelihood of success on its claim that the Department's effective cancellation of DV-2027 was arbitrary and capricious under the Administrative Procedure Act, 5 U.S.C. § 706(2)(A).
The court focused on the absence of a reasoned explanation for the prolonged failure to open registration. Although the Department previously referred to changes in the registration process, it had not adequately explained why that postponement became an indefinite suspension extending into the relevant visa fiscal year.
Under the APA, an agency generally must provide a rational explanation for its decisions, consider relevant factors and remain within the legal authority Congress has given it.
THE COURT'S CORE REASONING
An agency cannot effectively suspend a statutory program indefinitely without an adequate legal explanation.
The court found a likelihood of success on the arbitrary-and-capricious claim. It did not need to resolve the plaintiff's alternative unlawfully-withheld-action and ultra vires claims to grant preliminary relief.
Why Was Late Registration Still Legally Possible?
The government argued that the ordinary registration timetable had already passed and that requiring the Department to conduct the lottery after the beginning of FY2027 would conflict with the established statutory process.
The court distinguished the customary timing of registration from the explicit deadline governing Diversity Visa eligibility. It concluded that compelling the Department to start the delayed process would advance, rather than undermine, Congress's purpose in establishing the annual program.
This reasoning does not eliminate the fiscal-year limit. The court's authority to require delayed registration is different from any authority to issue DV-2027 visas after the statutory eligibility period.
Two Legally Different Questions
The court concluded that ordering the government to implement the delayed lottery could provide meaningful relief consistent with the program's statutory purpose.
No. The injunction does not create a general extension beyond the statutory fiscal-year cutoff.
The decision is a preliminary injunction, not a final judgment resolving every claim. The government retains the right to challenge the injunction through the appellate process.
03 / APPEAL STATUS
Government Appeal and Stay Request: Could DV-2027 Registration Be Delayed Again?
Yes. The court-ordered registration timetable could change if a court stays, modifies or reverses the injunction.
On October 20, 2026, Curtis Morrison of Red Eagle Law, the plaintiff in the case, publicly reported that Secretary Rubio had filed a notice of appeal and requested a stay of implementation of Judge Ohta's order. The reported request sought expedited consideration.
An independent Forbes article, updated on October 20, also reported that the government had appealed the decision.
These reports support the existence of an appellate challenge. They should not be confused with a judicial decision granting a stay.
STATUS AS OF OCTOBER 21, 2026
Appeal reported; no order granting the requested stay confirmed in the court materials reviewed
The amended registration deadlines should therefore be treated as existing court requirements, not guaranteed operational dates. Further judicial action may change the government's obligations.
What Would Different Outcomes Mean for Applicants?
If the stay is denied: the injunction would ordinarily remain enforceable unless another court changes it. The government would still face the amended deadlines.
If the stay is granted: implementation of some or all registration requirements could be suspended, potentially affecting the October 29 and November 1 dates.
If the appellate court modifies or reverses the injunction: the Department's obligations would depend on that later decision.
The appropriate approach is to monitor actual judicial rulings and official government announcements rather than predict the outcome of litigation.

04 / PARTICIPATION REQUIREMENTS
Who May Qualify for DV-2027?
The injunction does not waive the statutory eligibility requirements for the Diversity Visa Program. Reopening registration restores the opportunity to participate, but applicants must still satisfy the relevant immigration rules.
The Department has not yet published the final DV-2027-specific instructions or eligible-country list. Until it does, applicants should distinguish the existing statutory requirements from program-year details that remain unannounced.
Eligibility Is Generally Based on Country of Birth
DV eligibility generally depends on an applicant's country of birth rather than citizenship, ethnicity or current residence.
Under the statutory allocation system, countries with historically high immigration to the United States may be excluded from participation in a particular program year.
Limited alternative chargeability provisions can apply in qualifying circumstances involving a spouse or parents. These are legal exceptions, not a general right to select any country of citizenship.
The DV-2026 eligible-country list should not be treated as a confirmed DV-2027 list. Annual eligibility can change, and the relevant country instructions must be checked once published.
Education or Qualifying Work Experience
The principal applicant must generally satisfy one of two alternatives under the Diversity Visa rules.
Option A — Qualifying Education
Successful completion of formal primary and secondary education comparable to a 12-year U.S. course of study. A general equivalency certificate, such as a GED, does not automatically satisfy this requirement.
Option B — Qualifying Work Experience
At least two years of qualifying work experience within the preceding five years in an occupation that requires the relevant training or experience under U.S. Department of Labor standards. The occupation must generally be classified within O*NET Job Zone 4 or 5, with a Specific Vocational Preparation rating of at least 7.0.
These requirements apply to the principal Diversity Visa applicant. A spouse or child applying as a derivative is not independently required to meet the principal applicant's education or work-experience test.

05 / PRACTICAL PREPARATION
How Should Applicants Prepare Before DV-2027 Registration Opens?
Applicants should prepare accurate personal information and the documents required under existing regulations, while waiting for the Department to announce the actual registration window.
The delayed timetable makes preparation useful, but it does not justify paying intermediaries who claim to offer early registration or guaranteed selection.
Passport Requirements
A Department of State final rule effective April 10, 2026 generally requires principal DV entrants to provide information from a valid, unexpired passport and upload a scan of the passport's biographic and signature page.
The passport scan must be submitted in JPEG/JFIF format and must not exceed 5 MB. PDF is not accepted for this upload. Limited exemptions are available under the applicable regulation.
An applicant should not assume that having only a national identity card satisfies the passport requirement. Any claimed exemption must meet the relevant regulatory conditions.
Photographs and Family Information
The entry requires compliant photographs and accurate information about the principal entrant and qualifying family members. Photos generally must be recent, meet the official technical specifications and accurately represent the people identified.
Applicants should carefully check the required inclusion of an existing qualifying spouse and unmarried children under 21, including qualifying children who do not live with the principal entrant or do not plan to immigrate.
Some family-member exceptions apply, including rules concerning spouses or children who already hold U.S. citizenship or lawful permanent residence. The final DV-2027 instructions should be consulted before making these determinations.
The $1 Registration Fee
A State Department rule effective September 16, 2025 established a $1 electronic DV registration fee. The charge is separate from the later immigrant visa application fee paid by selected applicants who pursue consular processing.
The entry fee must be paid through the authorized government process. Paying a third-party service does not guarantee that an entry has been accepted or that the entrant will be selected.
More detail on passport scans, photographs and the electronic entry fee is available in Arvian's guide to the updated DV registration requirements. The DV-2028 registration schedule is a separate issue from the court-ordered DV-2027 reopening.
Applicant Preparation Checklist
- Check the final DV-2027 eligible-country instructions when released.
- Confirm the education or qualifying work-experience requirement.
- Prepare a valid passport and compliant scan unless an exemption applies.
- Verify names, birth dates, marital status and qualifying family details.
- Prepare recent photographs meeting government specifications.
- Use only the official government registration and payment systems.
- Submit no more than one entry per individual during the registration period.
- Save the official confirmation number after successful submission.
Preparing these items cannot increase the probability of random selection. It can, however, help avoid technical mistakes, omissions and unnecessary delays once registration becomes available.
06 / SELECTION RESULTS
How Will Applicants Find Out Whether They Were Selected for DV-2027?
The amended court timetable requires the Department of State to notify selected entrants by December 3, 2026. This is a judicial deadline and should not be confused with a separately confirmed date on which results will become accessible online.
Under the Department's established Diversity Visa procedure, Entrant Status Check is the official method for learning whether an entry has been selected.
Check Results Only Through the Government Portal
Applicants ordinarily use their confirmation number and identifying information to access Entrant Status Check when the Department makes results available for the relevant program year.
Will the State Department Email DV-2027 Winners?
Under the standard DV procedure, the Department does not send individual selection notifications by email or postal mail. Entrant Status Check is the official method of notification.
Selected applicants may later receive legitimate communications concerning case processing or interview scheduling. Those communications are different from the initial selection notification.
The Department has not yet independently confirmed the DV-2027 Entrant Status Check availability date. Any year-specific change in the notification procedure must come from an official government announcement.
Does Selection Guarantee a Green Card?
No. Being selected means the entrant may pursue the relevant Diversity Visa application process. It does not establish that the applicant is admissible, meets all eligibility requirements or will receive a visa.
Visa availability, case processing, legal eligibility and the fiscal-year deadline remain separate requirements.
07 / IMMIGRATION PROCESSING
Does the DV-2027 Court Order Also Allow Diversity Visas to Be Issued?
Not automatically. The injunction requiring DV-2027 registration to resume and the separate State Department policy governing Diversity Visa issuance are distinct legal and administrative matters.
On August 31, 2026, the Department published updated Diversity Visa issuance guidance. It stated that the earlier December 2025 pause had ceased to be effective on August 28 following an order in Medani v. Trump.
The same guidance announced a new suspension of Diversity Visa issuance. Under that policy, applications and interviews may continue, but the Department does not issue Diversity Visas while the suspension remains operative.
The guidance states that no exceptions are available under that issuance policy.
The October injunction in Red Eagle Law v. Rubio does not independently establish that the August 2026 issuance suspension has been withdrawn or rendered unenforceable. Subsequent agency instructions or separate court proceedings may affect the situation.

Why Is the Remaining DV-2027 Processing Window So Important?
Fiscal year 2027 began on October 1, 2026. If registration follows the revised judicial timetable and selection results become available in December, successful entrants will have less than ten months to complete the necessary immigration process before September 30, 2027.
Selected applicants may need to submit Form DS-260, obtain civil documents, complete medical examinations, attend an interview and pass applicable background and admissibility checks.
Consular appointment availability, security reviews, regional visa-number allocation and other legal or administrative issues may affect whether processing can be completed on time.
September 20 Is Not September 30
September 20, 2027: the processing horizon established in the amended injunction, subject to the available visa allocation and the court's precise requirements.
September 30, 2027: the end of the statutory DV-2027 eligibility period under the normal immigration framework.
Neither date guarantees that a particular selected individual will receive an interview, an immigrant visa or adjustment-of-status approval.
What About the Missing DV-2027 Visa Bulletin Cut-Offs?
The October 2026 Visa Bulletin did not publish DV-2027 regional rank cut-offs. The court order requiring registration does not itself generate selectee case numbers or make the relevant visa-number availability information immediately accessible.
The implications of the missing figures are covered separately in Why DV-2027 Cut-Offs Are Missing From the October 2026 Visa Bulletin.
08 / FREQUENTLY ASKED QUESTIONS
DV-2027 Registration and Court Order FAQ
Is DV-2027 registration open today?
No. As of October 21, 2026, the official registration system has not opened for DV-2027. The court has ordered the Department to announce and open registration by specific deadlines, but applicants must wait until the government portal actually accepts entries.
Is November 1, 2026 a guaranteed opening date?
No. It is the opening deadline imposed by the amended preliminary injunction. A stay, modification or appellate decision could change the schedule. The State Department must still announce the operational registration dates.
Does the government appeal automatically cancel the injunction?
No. Filing an appeal is not the same as receiving a court order that stays enforcement. A separate judicial ruling is needed to suspend or modify the applicable obligations.
When will DV-2027 selection results be available?
The amended court order requires notification of selected entrants by December 3, 2026. The Department has not independently confirmed the date when DV-2027 Entrant Status Check results will become accessible. Applicants should wait for the official announcement.
Will selected entrants receive an email?
Under the standard Diversity Visa procedure, the Department does not send individual winner notifications by email or postal mail. Entrant Status Check at https://dvprogram.state.gov/ is the official selection-notification system.
Do applicants need a passport and pay the $1 fee?
Under the currently effective rules, most principal entrants must provide valid passport information and a qualifying passport scan, subject to limited exemptions. A separate regulation establishes a $1 electronic entry fee. Applicants must follow the official DV-2027 instructions when released.
Is the DV-2027 eligible-country list available?
The final year-specific list has not yet been officially published as of this update. Eligibility generally depends on country of birth, and the list can change between program years. Applicants should not rely on the previous DV cycle's list as final.
Can an earlier DV entry be transferred to DV-2027?
No. Each Diversity Visa program year requires a separate entry and random selection process. An application submitted during an earlier DV registration period does not automatically count as an entry for DV-2027.
Does selection guarantee a Diversity Visa?
No. Selection allows a qualifying individual to pursue immigration processing. Issuance remains dependent on eligibility, admissibility, visa availability, completion of processing and applicable legal restrictions.
Can DV-2027 eligibility continue beyond September 30, 2027?
Under the ordinary statutory framework, DV-2027 eligibility ends with fiscal year 2027. The October 2026 preliminary injunction does not provide a general extension of that deadline.

THE PRACTICAL BOTTOM LINE
What Should DV-2027 Applicants Do Next?
The October 2026 injunction creates a court-ordered path toward reopening DV-2027 registration, but the litigation is not over. The government's appeal and stay request mean that the announced judicial deadlines may still be modified.
Applicants should watch for the next judicial ruling, the State Department's official registration announcement and activation of the electronic entry system.
Until registration actually opens, the practical priorities are to verify potential eligibility, prepare compliant documents and avoid private websites claiming to offer early participation.
The court order restores an opportunity to enter the DV-2027 lottery. It does not guarantee selection, visa issuance or permanent residence.
